Fees & Costs
On all general litigation matters, attorneys' fees are structured on an hourly basis. Our attorneys' fees for collection matters are structured on a flexible, contingency percentage basis. For all collection matters no attorneys' fees are due unless and until we collect.
With regard to collection matters, all claims under $25,000.00, to file suit in the five boroughs of New York City, Nassau and Suffolk Counties, we will require a check in the sum of $300.00 per claim, paid in advance, to cover initial filing costs and service of process. For all claims over $25,000.00, and for any claim under $25,000.00 which must be filed outside New York City, Nassau or Suffolk Counties, to file suit we will require a check in the sum of $650.00 per claim, paid in advance, to cover initial filing costs and service of process. We will advise you of and obtain prior approval for additional litigation costs as they may be required. These additional costs could include, among others, costs of filing motions, deposition costs, witness fees and post-judgment executions.
No suit will be commenced without prior written authorization from the client. After suit has been commenced, we will provide you with regular reports on the status of the claim.
We are prepared to handle these matters on the above stated basis provided there are no counterclaims or affirmative defenses. In the event a counterclaim or affirmative defense is asserted, we will promptly contact you to discuss a separate arrangement for handling the claim.
Our agreement to handle these matters does not include bankruptcy proceedings, appeals or a new trial of the same claim.
